By listing products on our platform, you represent and warrant that:

• Products comply with all applicable laws, regulations, and safety standards in Kenya and destination countries
• Products do not infringe any intellectual property rights (trademarks, copyrights, patents)
• All product information, descriptions, and images are accurate and truthful
• You have all necessary licenses, permits, and certifications to sell the products
• Products are safe for their intended use when used according to instructions
• You will fulfill all orders in a timely and professional manner
• You have appropriate insurance coverage for your business operations

2. Required Product Information

All product listings must include:

• Accurate Title: Clear, descriptive product name without misleading keywords
• Detailed Description: Comprehensive information about the product, including size, weight, materials, origin, condition
• Genuine Photos: Clear, high-quality images showing the actual product (not stock photos unless disclosed)
• Accurate Pricing: Correct pricing in KES including all applicable fees (shipping separate)
• Availability Status: Current stock status and estimated delivery time
• Category Classification: Proper categorization for easy browsing
• Condition: Whether product is new, used, refurbished, etc.
• Warnings and Restrictions: Any safety warnings, age restrictions, or usage limitations
• Return Policy: Your specific return and refund terms

4. Restricted Products (Require Documentation)

The following products require proper licenses, certifications, or documentation:

• Electronics: Must comply with KEBS standards, include proper certifications
• Food and Beverages: Require proper permits, expiration dates, ingredient lists
• Cosmetics and Personal Care: Must meet safety standards, include ingredient lists
• Baby Products: Must meet stringent safety standards
• Toys: Must comply with safety regulations, age-appropriate labeling
• Health Supplements: Require proper authorization and health warnings
• Electrical Items: Must meet safety standards, include proper warnings

Sellers must provide documentation upon request and are solely responsible for compliance.

5. Product Quality Standards

• Products must match their descriptions and images
• Products must be in the stated condition (new, used, etc.)

• Used products must disclose all defects, damages, or wear
• Products must be properly packaged to prevent damage during shipping

6. Pricing and Fees

• Duplicate Listings: Creating multiple listings for the same product
• Misleading Descriptions: False claims about product features or benefits
• Hidden Fees: Not disclosing mandatory additional costs
• False Scarcity: Fake "limited stock" or "urgency" tactics
• Review Manipulation: Fake reviews or incentivizing positive reviews
• Price Manipulation: Artificial inflation followed by fake "discounts"

8. Intellectual Property Compliance

Sellers must ensure:

• They own or have authorization for all trademarks used in listings
• Products are genuine and not counterfeit
• Images and descriptions do not infringe copyrights
• Brand names are used only for genuine products
• No unauthorized use of celebrity names or images

Sellers are fully liable for any intellectual property infringement. We will comply with legal IP protection requests.

9. Order Fulfillment Requirements

• Ship orders within stated timeframe (typically 1-3 business days)
• Package items securely to prevent damage
• Provide tracking information when available
• Include invoice or receipt with shipment
• Ship the exact product as listed (no substitutions without buyer consent)
• Notify buyers immediately of any delays or issues
• Respond to buyer inquiries within 24 hours

10. Returns and Customer Service

• Accept returns for defective, damaged, or misrepresented products
• Process refunds promptly after receiving returned items

13. Seller Liability and Indemnification

Sellers agree to:

• Indemnify WholesaleKenya.com from any claims arising from their products or listings
• Maintain appropriate liability insurance
• Handle all customer service issues and complaints
• Pay all applicable taxes and fees
• Comply with all applicable laws and regulations
• Accept full responsibility for product safety and quality
